1. Agreement to Terms

By accessing or using the AI Lead Machine platform ("Service") operated by Kindai Pty Ltd (ABN to be registered) trading as Kindai ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

These terms apply to all visitors, users, and customers who access or use the Service available at aileads.manus.space and any associated subdomains or services.

2. Description of Service

AI Lead Machine is an AI-powered customer engagement platform designed for Australian trade businesses. The Service includes an AI chatbot that responds to customer enquiries, captures lead information, and facilitates appointment booking on behalf of your business.

We provide a done-for-you setup of the AI chatbot customised to your trade business, along with ongoing hosting, maintenance, and performance reporting.

3. Pricing and Payment

Our Service is offered under the following pricing structure:

  • Setup Fee: A one-time payment of A$497 (inc. GST) for the done-for-you AI chatbot setup, customisation, and deployment
  • Monthly Retainer: A recurring payment of A$97/month (inc. GST) for hosting, maintenance, updates, and monthly performance reports

All payments are processed securely through Stripe. Prices are in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change our pricing with 30 days' written notice to existing customers.

4. Refund Policy

We offer a 14-day satisfaction guarantee on the setup fee. If you are not satisfied with the AI Lead Machine within 14 days of deployment, contact us at [email protected] and we will provide a full refund of the setup fee.

Monthly retainer payments are non-refundable for the current billing period. You may cancel your subscription at any time, and it will remain active until the end of the current billing cycle.

5. Cancellation

You may cancel your monthly retainer subscription at any time by contacting us at [email protected] or through your account dashboard. Upon cancellation:

  • Your AI chatbot will remain active until the end of the current billing period
  • No further charges will be made after the current period ends
  • We will provide you with any lead data collected during your subscription upon request

6. Your Responsibilities

As a user of the Service, you agree to:

  • Provide accurate and complete business information during onboarding
  • Respond to leads captured by the AI chatbot in a timely manner
  • Not use the Service for any unlawful purpose or in violation of any applicable laws
  • Not attempt to reverse engineer, decompile, or disassemble the Service
  • Not use the Service to send spam, misleading information, or harass any person
  • Maintain the confidentiality of your account credentials

7. AI Chatbot Limitations

The AI chatbot is designed to capture leads and facilitate customer enquiries. While we strive for accuracy, you acknowledge that:

  • The AI chatbot may occasionally provide incorrect or incomplete responses
  • The chatbot is not a substitute for professional advice or human customer service
  • We do not guarantee any specific number of leads, conversions, or revenue outcomes
  • Response quality depends on the accuracy of the business information you provide during onboarding

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Kindai and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of all business information, branding, and content you provide to us during onboarding. We are granted a non-exclusive licence to use this content solely for the purpose of operating the AI chatbot on your behalf.

9. Limitation of Liability

To the maximum extent permitted by Australian law, Kindai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

Nothing in these terms excludes or limits any consumer guarantees under the Australian Consumer Law that cannot be excluded or limited by law.

10. Indemnification

You agree to indemnify and hold harmless Kindai, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these terms, or your violation of any rights of a third party.

11. Service Availability

We strive to maintain 99.9% uptime for the AI chatbot service. However, we do not guarantee uninterrupted access and may occasionally need to perform maintenance or updates. We will provide reasonable notice of any planned downtime where possible.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
